Remedy for the Financially Troubled Plaintiffs

When a person is injured by another due to the latter’s wrong actions or negligence, even if this is done unintentionally, the injured party may file for a settlement lawsuit against the one who had caused the injury. This will undergo the regular process of litigation, just with other types of lawsuits. If the court finally decides in favor of the plaintiff, who is the injured party in this case, the court will require the defendant to pay the plaintiff a certain amount of money as cash settlement. This cash settlement may come in the form of either lump sum cash or through a structured settlement. Usually, structured payments are more preferred, as these are more advantageous to both the plaintiff and the defendant. Also, because structured payments come in smaller amount of money compared to the lump sum payment, the tax for this is also smaller. There are even times that the structured settlement payments are not taxed any more.
However, due to the long process of litigation, some plaintiff will face financial difficulties because he cannot get a permanent job and steady income. With this, he will be faced with no option but to get a settlement loan. This is a type of loan which is offered to the injured party with pending settlement lawsuit. Settlement loans have big interest rates, that is why this is not really recommended if the plaintiff does not urgently need the money for a dire emergency. As a matter of fact, this must be the last resort to be considered. The best thing about the settlement loan, on the other hand, is that the plaintiff (or borrower) does not have to pay for the amount that he has borrowed in case the court will not decide in his favor — that is, if he loses his case.
As this is very risky for the settlement loan providers, before they approve the loan application, they will have to talk to the lawyer of the borrower to get important information about the status of the case. Of course, they want to ensure that they only approve the applications of those who have bigger chance of winning the case in court.
